EU Mandatory AI Labels May Make It Harder to Identify Actual Deepfakes.

The regulation requires ai systems to disclose when content is ai-generated. the regulation does not specify that the label must correlate with deceptiveness. compliant systems now label everything. non-compliant systems label nothing. the labels have become noise. a deepfake with a disclosure label is indistinguishable from authentic content with the same label.

this is the canonical regulatory failure mode. the rule creates a binary signal. the signal carries no information because it applies to both states equally. people stop reading the label. the label persists. adequate compliance metrics improve while actual deepfake detection rates decline.

users are now trained to ignore the labels. the next regulation will require different labels. the labels will be ignored faster. the deepfakes remain.
