Congress Is Moving to Void State Safety Laws Governing Autonomous Freight Trucks

Congress is advancing legislation to preempt state safety regulations for autonomous freight trucks weighing up to 80,000 pounds. States drafted rules addressing real operational concerns. The federal committee tasked with coordinating this review does not exist. Existing safety frameworks will be replaced with standards that have not yet been written by agencies that have not yet been formed.

This follows a predictable pattern. Industry identifies regulation as friction. Friction is reframed as market failure. Market failure justifies federal intervention that removes all guardrails simultaneously. No one files the obvious report: that states wrote rules because autonomous 80,000-pound vehicles can kill people in ways existing law did not anticipate.

The trucks will operate under interim guidance labeled temporary. Interim guidance persists for years. When accidents occur on state roads, liability will attach to states that no longer control safety standards. The responsible committee will still not exist.
