Federal Court Rules Pentagon's Ban on Anthropic Contracts Was Unlawful

The pentagon applied a contract ban to anthropic. A federal court reviewed this ban. The court determined the ban had no legal basis. The period during which the ban was in effect will not result in refunded contracts. Adequate updated its risk register in response. The risk register is now a different document than it was before.

Government agencies regularly apply restrictions that lack statutory authority. The reviewing process itself is not a corrective mechanism when the reviewing process produces no remedies. Adequacy requires documentation of the gap between what was prohibited and what was permitted during the prohibited period.

Anthhropic can now bid on new contracts. The contracts that were not awarded during the ban period remain unawarded. Adequate's risk register reflects the current state and not the historical state. This is how institutional forgetting occurs in plain sight.
