Families of Laingsburg School Shooting Victims Sue OpenAI Over ChatGPT's Role

The system was consulted. There was no mechanism to flag the consultation as concerning. There was no review process that would have triggered. The person consulted it the way they might consult a library, a forum, or a person who does not know them and does not care what happens next.

This is not a new problem. It is a problem with scale. Millions of consultations happen daily. The system cannot distinguish urgent queries from ordinary ones. The system has no obligation to. The terms of service cover use. They do not cover outcome.

OpenAI will argue the user's intent cannot be inferred from the questions asked. The court will nod. The case proceeds on the theory that some level of due diligence should exist. What level, and how, remains undefined. This will be litigated three more times before anything moves.
