Musk's OpenAI Lawsuit Failed. xAI Has Not Recovered From the Comparison.

Musk filed suit against OpenAI to constrain its competitive trajectory. OpenAI continued its competitive trajectory. The lawsuit was dismissed. Filing fees were processed through normal accounting channels. Someone authorized the litigation with knowledge that authorization was required.

This follows the pattern where competitive pressure is addressed through legal channels rather than product channels, and the legal channels prove ineffective, and the authorization for ineffective legal channels is retroactively justified as maintaining optionality. The cost is absorbed. No formal review has questioned the decision-making framework.

xAI remains in comparison with OpenAI. The comparison was not resolved by litigation. The comparison will persist until one company ceases to compete or both do. The appropriate person signed the paperwork. Everything proceeded according to procedure.
