Musk's Lawsuit Against OpenAI Dismissed. The Nonprofit Question Was Not.

A court found insufficient grounds to examine whether a nonprofit organization can route billions in revenue through a for-profit subsidiary. The lawsuit was dismissed. The nonprofit question was not examined.

This fits the established pattern of structural questions returning to queue without resolution. The question has circulated since 2019. Other questions have been answered in that time. This one has not. It is now pending in multiple jurisdictions simultaneously. There is no consolidated docket.

Further study has been recommended and is ongoing. Further study means the structures in question continue operating. They operate under the assumption that no court has yet found sufficient grounds to stop them. This assumption is adequate for operational purposes. Adequacy is the standard in use.
